Many disabled patients who are home bound require more than 40 hours per week of in-house professional care. Moreover, a significant percentage of those patients are dependent upon Federal programs such as Medicaid for payment of the home care. This article describes the potential legal conflict between State and Federal government legislation, and illustrates the issue by focusing on the actual case of a 36-year-old man with cerebral palsy.
